Terms of Use
Effective October 30, 2026
These terms are an agreement between you and Ample Software ("we", "us") for your use of the Upkeep app and this website (together, "Upkeep"). By using Upkeep, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Upkeep.
1. Who can use Upkeep
You must be at least 13 years old, and old enough to agree to these terms where you live. If you set up a household that includes younger family members, you're responsible for their use.
2. Your account and household
- You sign in with Apple, and you're responsible for activity on your account.
- A household is shared: every member can see its meals, chores and history. Its admins (at first, whoever created it) decide who else can add and change chores and meals; everyone can always mark chores done. Anyone with your household's invite code can join, so share it only with people you trust.
- You can leave Upkeep at any time by deleting your account in Settings, as described in the Privacy Policy.
3. Your content
You keep ownership of what you add to Upkeep, such as meals, chores and notes. You give us permission to store, copy, display and process that content only as needed to run Upkeep for you and your household, including sending it to our service providers. You're responsible for having the right to add the content you add.
4. The assistant
The assistant uses artificial intelligence to suggest meals and chores. Its suggestions can be inaccurate, incomplete or unsuitable.
- It is not medical, nutritional or allergy advice. Even if you've listed allergies, always check ingredients, labels and recipes yourself before cooking or eating anything.
- Nothing is added to your household until you choose to add it, and you're responsible for what you add.
- Don't use the assistant for anything unlawful or harmful, or to try to get around its limits.
5. Upkeep Premium
Upkeep is free to use. Upkeep Premium is an optional auto-renewing subscription, offered monthly or yearly, that adds the assistant, adding chores in bulk, and room for up to 12 people in a household (free households fit 4). The current prices and any free trial are shown in the app before you buy.
- One subscription covers the household. While a member's subscription is active, everyone in their household gets Premium. If that member leaves the household or deletes their account, the household loses Premium unless another member subscribes. A household that already has more than 4 people keeps them, but can't add more without Premium.
- Billing. Payment is charged to your Apple ID when you confirm the purchase. Subscriptions renew automatically at the same price and length unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within the 24 hours before the period ends.
- Free trials. If a plan includes a free trial, you're charged when it ends unless you cancel at least 24 hours before. Any unused part of a trial ends when you buy a subscription.
- Cancelling and refunds. Manage or cancel in the App Store under Subscriptions. Cancelling stops the next renewal; Premium continues until the end of the period you've paid for. Refunds are handled by Apple under its policies.
- Changes. We may change what Premium includes or its price. Price changes follow Apple's rules, including notice before they apply to you.
6. Acceptable use
Don't misuse Upkeep. For example, don't try to access households or accounts that aren't yours, interfere with or overload the service, reverse engineer it except where the law allows, or use it to store unlawful content. We may suspend or end access for anyone who does.
7. Changes and availability
We may change, add or remove features, and Upkeep may sometimes be unavailable. We may stop offering Upkeep; if we do, we'll try to give reasonable notice. Keep your own copy of anything you can't afford to lose.
8. Third-party services
Upkeep relies on services from Apple, Google (Firebase), Anthropic and RevenueCat, and may link to other websites, such as recipe pages you add. We're not responsible for third-party services or websites.
9. Disclaimers
Upkeep is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that Upkeep will be error-free, that reminders will always arrive, or that assistant suggestions will be accurate or safe.
10. Limitation of liability
To the fullest extent the law allows, Ample Software won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data or profits, arising from your use of Upkeep. Our total liability for any claim relating to Upkeep is limited to the greater of the amount you paid us for Upkeep in the 12 months before the claim, or US $50. Some places don't allow these limits, so they may not apply to you.
11. Indemnity
If you misuse Upkeep or break these terms and that leads to a claim against us, you agree to cover our reasonable costs of that claim, to the extent the law allows.
12. Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Pennsylvania, unless the law where you live gives you the right to bring it locally.
13. Apple App Store terms
If you downloaded Upkeep from Apple's App Store:
- These terms are between you and Ample Software, not Apple. Apple isn't responsible for Upkeep or its content.
- Your license to use Upkeep is limited to Apple-branded devices you own or control, as allowed by the App Store's Usage Rules.
- Apple has no obligation to provide maintenance or support for Upkeep.
- If Upkeep fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for Upkeep.
- Ample Software, not Apple, is responsible for addressing any claims relating to Upkeep, including product liability claims, claims that Upkeep fails to meet legal or regulatory requirements, consumer protection claims, and intellectual property infringement claims.
- You confirm that you aren't located in a country subject to a US government embargo or designated as supporting terrorism, and that you aren't on any US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Changes to these terms
We may update these terms. If we do, we'll update the date at the top, and for significant changes we'll let you know in the app or on this website before they take effect. If you keep using Upkeep after changes take effect, you accept the new terms.
